Chief Ingredient, Inc. (“Chief Ingredient,” “we” or “us”) provides this website (in these terms we call this site and the Blazon software application provided by Chief Ingredient for use with the site www.blazonapp.com, the “Site”) to you subject to this Privacy Policy (“Privacy Policy”).

Chief Ingredient’s customers and persons to whom customers give access to their Blazon account are called “Subscribers.”

Chief Ingredient’s customers offering contests via the Site, from the Blazon system, are called “Advertisers” and individuals who participate in contests and promotions via the Site are called “Entrants.”

Users of the Site, whether they are Subscribers, Advertisers, Entrants, or people who post comments on the Chief Ingredient blog, or casual browsers of the Site, are called “Users.”

Chief Ingredient may maintain approved business relationships with “Affiliates”.

Chief Ingredient has been awarded TRUSTe’s Privacy Seal signifying that this privacy policy and practices have been reviewed by TRUSTe for compliance with TRUSTe’s program requirements including transparency, accountability and choice regarding the collection and use of your personal information.  The TRUSTe program covers only information that is collected through this website.

Chief Ingredient complies with the U.S. – E.U. Safe Harbor framework and the U.S. – Swiss Safe Harbor framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal data from European Union member countries and Switzerland. We Collect Certain Data

You acknowledge that we will collect certain information about Subscribers, Advertisers, Entrants and Users.  Subscribers, Advertisers, Entrants and Users may provide Chief Ingredient information regarding tastes and preferences.  Chief Ingredient may collect billing data pertaining to its Subscribers or Advertisers.  Chief Ingredient uses billing information for billing purposes only.  We will not share billing information without prior written consent of our Subscribers or Advertisers.

Collected information is used to process your orders as a Subscriber or Advertiser, and it is also used to process Entrant data.  We may use this to personalize the experiences of Users of the Site. Please review the “Required Information” section below for more information.

It is Protected

Subscribers and Advertisers Billing Data

Subscriber and Advertiser information is protected by secure server software.  Sensitive billing information is stored using several layers of encryption in a segmented network with no public internet access.  New encryption keys are generated on a daily basis, existing keys are rotated on a regular basis. Sensitive information is encrypted by an SSL connection when in transit over public networks.  SSL connections are limited to SSLv3 and TLSv1. Our billing vendor adheres to the PCI Data Security Standard (PCI DSS) for Service Providers.

Physical access to the network is strictly limited and monitored. Private networks are strictly segmented according to function. Restrictive firewalls protect communication entering the network and between private networks. All access to the network and its services is strictly logged. Audit logs are reviewed on a regular basis. Internal and external network penetration tests are performed on a regular basis by third-parties. Two-factor authentication and strong password controls are required for administrative access.

Users

By using the Site you consent to the collection and use of certain information by Chief Ingredient and our affiliates.  Any changes to Chief Ingredient’s Privacy Policy will be posted on our websites or in our applications so you will always be aware of information collected and used.

Customer billing protection is described above.  Other User data is protected on networks and servers are fully secured and guaranteed PCI compliant by a third party company at all times.

This begins with limiting SSL connections to SSLv3 and TLSv1, per PCI standards. As well as disallowing all SSH access to their servers.

Secure passwords are required of all users, and are used on all servers.  Only SSH keys are allowed for accessing the SSH server from within internal or external networks.

All servers are updated monthly with the latest cPanel, Apache, PHP, and MySQL programs to prevent intrusions.  Additionally, firewall rules and checks are in place to prevent access to sensitive applications, and incorrect login attempts result in automatic blocks of IP addresses for all services, including ssh, http, pop3, imap, smtp, cpanel, mysql, even though these may not all be accessible from the outside.

Entrants

By using the Site as an Entrant you consent to the collection and use of certain information by Chief Ingredient and our affiliates.  All entrants have the opportunity to opt-out of receiving additional promotional data at the time of entry.  All entrants, in order to enter a promotion, have the option of agreeing to the terms of that promotion.  Should they not, we collect no information on that entrant and they do not enter the promotion.

Required Information

To Purchase From Chief Ingredient

To purchase items via the Site basic name, email address and other contact information is collected.  We use this information for internal purposes only, namely, for processing orders, notifying Subscribers and Advertisers of order status, and sending notices of special offers and promotions, new services, and noteworthy news and events.  Subscribers and Advertisers may opt-out of future promotional emails or offers.  Subscribers and Advertisers are given this opportunity in any outreach, or at the time of data collection.

To Enter a Blazon Contest

To enter contests and promotions via Blazon Entrants provide basic name, email address and other contact information.  Also responses to questions may be collected.  We may use this information for subsequent promotional activities, for offerings of Subscriber or Advertiser products or services, and for noteworthy news and events.

All Blazon contests have opt-out features, and this is not a removable feature.  In order to promote adherence to the wishes of those who opt-out, Subscribers and Advertisers are encouraged to adhere to CAN-SPAM standards.  We reserve the right to terminate Subscribers and Advertisers who violate these standards.

To Interact with Our Site

To receive our newsletter or promotional emails, submit an inquiry and comment on our blog page basic name, email address and other contact information is collected.  We use this information to respond to your requests, provide you information and allow you to interact with our site. You should be aware that any information you provide within our blogs may be read, collected, and used by others who access them.

Disclosure of Information

We will share your personal information with third parties only in the ways that are described in this privacy statement.  We do not sell or rent information about our Subscribers, Advertisers, or Entrants to third parties. However, we may share or license Entrant information to Subscribers, Advertisers and Affiliates to enable them to provide special benefits, offers, and promotions to Entrants.  An Entrant may opt-out of the repurposing of their data for subsequent contact by either Chief Ingredient, its Subscribers, Advertisers or Affiliates by not selecting an opt-in check box in any Blazon promotion.  Blazon promotions cannot be deployed without this option.

We may provide your personal information to companies that provide services to help us with our business activities such as processing payments on our behalf. These companies are authorized to use your personal information only as necessary to provide these services to us.

We may also disclose your personal information:

  • as required by law, such as to comply with a subpoena, or similar legal process
  • when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request,
  • if Chief Ingredient is involved in a merger, acquisition, or sale of all or a portion of its assets,  you will be notified via email and/or a prominent notice on our Web site of any change in ownership or uses of your personal information, as well as any choices you may have regarding your personal information,
  • to any other third party with your prior consent to do so.

Cookies & Other Technologies

A cookie is a small text file that is stored on a user’s computer for record-keeping purposes. We use both session ID cookies and persistent cookies on this site. We use session cookies to make it easier for you to navigate our site and persistent cookies to better understand how users interact with our site. Session ID cookies expire when you close your browser while persistent cookies remain on your hard drive for an extended period of time. You can remove persistent cookies by following directions provided in your Internet browser’s “help” file.  We do not link the information we store in cookies to any personally identifiable information you submit while on our site.

If you reject cookies, you may still use our site, but your ability to use some areas of our site, such as contests or surveys, will be limited.

Our third party partners employ clear gifs (a.k.a. Web Beacons/Web Bugs), images, and scripts that help them better manage content on our site. We do not tie the information gathered to your personally identifiable information.

Subscriber, Advertiser or Affiliate Policies

Our Subscribers, Advertisers, and Affiliates Privacy Policies and practices may be different from Chief Ingredient’s Privacy Policies and we encourage you to become familiar with them.

Chief Ingredient assumes no responsibility for these policies.

You may choose to not receive e-mails or updates about special benefits, promotions, or offers from Us, our Subscribers, Advertisers or Affiliates. Chief Ingredient will always provide the opportunity to elect not to receive such materials in our own promotional activities.

Subscribers, Advertisers, and Entrants may choose to not receive e-mails or updates about special benefits, promotions, or offers from Us.  Subscribers, Advertisers, and Affilitates will always be provided opt-out provisions in any electronic communication.

CAN-SPAM Act

Chief Ingredient complies with the requirements of the CAN-SPAM Act.

Our Sites or Blazon promotions may contains links to other sites. Please be aware that Chief Ingredient is not responsible for the privacy practices of such other sites. We encourage our Users to be aware when they leave our site and to read the privacy statements of each and every web site that collects personally identifiable information.

Change of Address or Contact Information

If you have supplied personal information to us and would like to correct, update or request the deletion of that information, please contact us via one of the methods listed below.  If you have a Blazon account, you may also access your information by logging on to “Your Account” and edit your personal information, where applicable. In some cases, we may not be able to remove your personal information, in which case we will let you know if we are unable to do so and why. We will respond to your access requests within 30 days.

We will retain your information for as long as your account is active or as needed to provide you services.  We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Choice/Opt-out

Out of respect for your privacy, you may choose to stop receiving our newsletter or marketing emails by following the unsubscribe instructions included in these emails, accessing the email preferences in your account settings page or by contacting us via one of the methods listed below.
